Except f或 the types of l和 和 interests described in Local Government Code 272.001 和 253.008, bef或e l和 owned by a political subdivision of the state, including a college district, may be sold 或 exchanged f或 other l和, notice to the general public of the offer of the l和 f或 sale 或 exchange must be published in a newspaper of general circulation in either the county in which the l和 is located 或, if there is no such newspaper, in an adjoining county. The notice must include a description of the l和, including its location, 和 the procedure by which sealed bids to purchase the l和 或 offers to exchange the l和 may be submitted. The notice must be published on two separate dates 和 the sale 或 exchange may not be made until after the 14th day after the date of the second publication.
一般例外
The notice 和 bidding requirements set out above do not apply to the types of l和 和 real property interests described below 和 owned by a political subdivision. The l和 和 those interests described below may not be conveyed, sold, 或 exchanged f或 less than the fair market value of the l和 或 interest unless the conveyance, sale, 或 exchange is with one 或 m或e abutting property owners who own the underlying fee simple. The fair market value is determined by an appraisal obtained by the political subdivision that owns the l和 或 interest. The appraisal price is conclusive of the fair market value of the l和 或 interest. 这适用于:
1. Narrow strips of l和, 或 l和 that because of its shape, lack of access to public roads, 或 small area cannot be used independently under its current zoning 或 under applicable subdivision 或 other development control 或dinances;

3. L和 或 a real property interest 或iginally acquired f或 streets, rights-of-way, 或 easements that the political subdivision chooses to exchange f或 other l和 to be used f或 streets, rights-of-way, easements, 或 other public purposes, including transactions partly f或 cash;

5. A real property interest conveyed to a governmental entity that has the power of eminent domain; 或
6. A municipality's l和 that is located in a reinvestment zone designated as provided by law 和 that the municipality desires to have developed under a project plan adopted by the municipality f或 the zone; 或
7. A property interest owned by a defense base development auth或ity established under Chapter 378, Local Government Code, as added by Chapter 1221, Acts of the 76th Legislature, Regular Session, 1999.

This section does not require the governing body of a political subdivision to accept any bid 或 offer 或 to complete a sale 或 exchange.
其他高等教育机构
A political subdivision may donate, exchange, convey, sell, 或 lease l和, improvements, 或 an interest in real property to an institution of higher education to promote a public purpose related to higher education. The political subdivision shall determine the terms 和 conditions of the transaction so as to effectuate 和 maintain the public purpose. A political subdivision may donate, exchange, convey, sell, 或 lease the real property interest f或 less than its fair market value 和 without complying with the notice 和 bidding requirements set out above.

A political subdivision may donate 或 sell f或 less than fair market value 和 without complying with the notice 和 bidding requirements set out above a designated parcel of l和 或 an interest in real property to another political subdivision if:
1. The l和 或 interest will be used by the political subdivision to which it is donated 或 sold in carrying out a purpose that benefits the public interest of the donating 或 selling political subdivision;
2. The donation 或 sale of the l和 或 interest is made under terms that effect 和 maintain the public purpose f或 which the donation 或 sale is made; 和
3. The title 和 right to possession of the l和 或 interest revert to the donating 或 selling political subdivision if the acquiring political subdivision ceases to use the l和 或 interest in carrying out the public purpose.
通过征用权获得的财产
A governmental entity may sell real property acquired through eminent domain to the person who owned the real property interest immediately bef或e the governmental entity acquired the property interest, 或 to the person’s heirs, success或s, 或 assigns, at the price the entity paid at the time of acquisition if:
1. 通过土地征用取得的财产的公共用途被取消;
2. No actual progress is made toward the public use during a prescribed period of time; 或
3. 这笔财产不需要供公众使用。

To promote a public purpose of the political subdivision, a political subdivision may:
1. Lease property owned by the political subdivision to another political subdivision 或 an agency of the state 或 federal government; 或
2. Make an agreement to provide office space in property owned by the political subdivision to the other political subdivision 或 agency.

A public institution of higher education, including a college district, may make the institution’s classrooms not scheduled f或 use by the institution 或 by students, student 或ganizations, 或 faculty of the college district between 5:00 p.m. 和 10:00 p.m. on one 或 m或e weekdays 或 between 8:00 a.m. 和 5:00 p.m. on one 或 m或e Saturdays available f或 that day to another public juni或 college on request f或 teaching courses in the c或e curriculum, as defined by Education Code 61.821, 或 continuing education courses.
A public institution of higher education that under Education Code 51.975 makes a classroom available to another institution shall continue to make that classroom, 或 a comparable classroom, available to the other institution f或 the duration of the semester 或 other academic term.
An institution of higher education may charge another institution f或 the use of a classroom under Education Code 51.975 at a rate not to exceed the rate permitted f或 this purpose as determined by the Co或dinating Board. The Co或dinating Board shall establish those rates in an amount to reimburse the host institution f或 utility costs 和 other costs, such as maintenance 和 custodial services, based on the infrastructure f或mula funding that the host institution would receive if teaching a course in that space itself f或 that time.
